Terms and Conditions
This Subscribership Agreement governs your application, participation in the Swift Ride subscription program, and access to related services.
IMPORTANT LEGAL NOTICE
PLEASE READ THESE TERMS CAREFULLY BEFORE USING ANY SWIFT RIDE VEHICLES OR SERVICES. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING REQUIRING BINDING INDIVIDUAL ARBITRATION AND LIMITING YOUR RIGHT TO BRING A LAWSUIT OR CLASS ACTION (SEE SECTION 11). IF YOU DO NOT ACCEPT ALL TERMS, YOU ARE NOT AUTHORIZED TO PARTICIPATE IN THE SWIFT RIDE PROGRAM.
This Subscribership Agreement, along with its Schedules and associated Rules (collectively referred to as this "Agreement"), constitutes an agreement between Swift Ride, Inc. or one of its affiliated companies ("Swift Ride," "us," or "we") and you ("Subscriber," "the user," "the driver," or "you"). This program allows you to use and take custody of one or more vehicles made available by Swift Ride ("Swift Ride Vehicle").
Swift Ride reserves the right to change the terms of this Agreement from time to time. Continued use of the Swift Ride Program constitutes acceptance of any amended terms and conditions. Certain provisions may vary based upon the jurisdiction in which you reserve or use a Swift Ride Vehicle.
This Agreement is an agreement for the use and custodianship of one or more Swift Ride Vehicles but does not in itself confer any right to participate in the Swift Ride Program. A Subscriber may only participate in the Swift Ride Program, to the extent available, in accordance with the terms of this Agreement and subject to paying all applicable fees and charges.
Swift Ride is the owner of any item it provides to the Subscriber, including all Swift Ride Vehicles, mobile and web-based applications. The Subscriber's rights are limited to those stated in this Agreement.
Rental Period: The initial rental period is 7 calendar days. Unless you return the Swift Ride Vehicle on or before the Return Date, the rental will automatically renew for additional 7-day periods, subject to applicable state law.
Swift Ride may refuse to rent, terminate membership, or terminate this Agreement for reasons including: suspended/revoked driver's license, failure to provide required documentation, past due payments, vehicle repossession, damaged vehicle returns, excessive cleaning fees, prohibited use, or excessive no shows/cancellations.
